Eligibility and Accounts
You must have legal capacity to enter into a binding agreement to use the Services.
You are responsible for maintaining the security of your account credentials and for activities conducted through your account. You must provide accurate information and promptly notify WHUE of suspected unauthorized access.
Customer Responsibilities
You are responsible for how you configure and use WHUE.
You agree to use the Services in accordance with applicable laws and regulations; obtain any notices, permissions, and consents required for calls, recordings, messages, marketing communications, or collection of personal information; ensure information supplied to WHUE is accurate and lawfully obtained; configure WHUE appropriately for your business and industry; review automated workflows before deploying them where appropriate; and not use WHUE for unlawful, deceptive, fraudulent, abusive, or harmful activity.
You are responsible for determining whether WHUE is appropriate for your particular business, regulatory environment, and use case.
AI-Generated Communications
WHUE uses artificial intelligence and automated systems.
AI systems are probabilistic and may occasionally misunderstand a caller, provide inaccurate information, incorrectly classify information, fail to complete an action, or otherwise produce unexpected results.
WHUE does not guarantee that AI-generated responses, transcripts, summaries, classifications, appointments, messages, integrations, or other outputs will always be accurate, complete, or error-free.
Customers remain responsible for reviewing their configuration and determining when human oversight is appropriate.
Calls and Recordings
WHUE may enable calls to be recorded, transcribed, summarized, or otherwise processed depending on customer configuration.
Customers are responsible for ensuring that appropriate notices and legally required consent are provided before using recording or transcription functionality.
WHUE may provide tools or automated disclosures to assist customers, but availability of those tools does not transfer the customer's legal compliance responsibilities to WHUE.
Messaging
Customers using WHUE to send SMS, MMS, email, or similar communications must have appropriate authorization to contact each recipient.
Customers may not use WHUE to send unsolicited bulk communications or messages to individuals who have not provided the consent required by applicable law or applicable telecommunications requirements.
Recipients' opt-out requests must be honored. Additional requirements governing text messaging may be contained in separate WHUE SMS Terms.
Third-Party Services and Integrations
WHUE may integrate with third-party platforms, telecommunications providers, calendars, CRMs, email providers, payment processors, AI providers, and other services.
Your use of third-party services may also be governed by their respective terms.
WHUE is not responsible for outages, changes, restrictions, errors, data loss, or other issues caused by third-party services outside WHUE's reasonable control.
Fees and Payment
Certain Services require payment.
Pricing, included usage, overage charges, billing periods, trials, and other commercial terms may be stated on an order form, subscription page, proposal, or other agreement between WHUE and the customer.
Unless otherwise stated in an applicable agreement, fees are non-refundable except where required by law. Failure to pay amounts when due may result in suspension or termination of Services.
Trials and Promotional Access
WHUE may offer trials, pilot programs, credits, or promotional access.
Trial availability, duration, included usage, and restrictions may vary. WHUE may modify or discontinue a trial or promotional program subject to applicable agreements and law.
Intellectual Property
WHUE and its licensors retain all rights, title, and interest in the Services, including WHUE software, designs, technology, models, interfaces, branding, documentation, and related intellectual property.
Except for the limited right to use the Services under these Terms, no rights are transferred to you.
Customers retain ownership of content and business information they provide to WHUE, subject to the rights necessary for WHUE to operate, secure, maintain, and provide the Services.
Feedback
If you voluntarily provide suggestions, ideas, or feedback regarding WHUE, you permit WHUE to use that feedback without restriction or compensation to improve or develop its products and services.
Prohibited Uses
You may not use WHUE to violate applicable law; commit fraud or impersonate another person without authorization; facilitate harassment, threats, or abuse; distribute malware or interfere with computer systems; obtain unauthorized access to accounts or information; send unlawful or unauthorized communications; circumvent consent or opt-out requirements; infringe intellectual property or privacy rights; or interfere with the operation or security of WHUE.
WHUE may suspend or terminate access when we reasonably believe use of the Services violates these Terms or creates material legal, security, or operational risk.
Service Availability
WHUE works to provide reliable Services but does not guarantee uninterrupted or error-free operation.
The Services may occasionally be unavailable because of maintenance, telecommunications failures, third-party outages, software issues, force majeure events, or circumstances outside WHUE's reasonable control.

Suspension and Termination
You may stop using WHUE at any time, subject to any separate contractual commitments.
